FTC warns CBD marketers: 'It's not the Wild West'

Health-related representations for CBD products are subject to the same established requirements of scientific substantiation the FTC has applied for decades to any advertised health claim. This is "one thing marketers of CBD products need to know right now," according to the Commission, spotlighting its enforcement sweep, "Operation CBDeceit."

CRN alerted members to FTC's announcement yesterday in a late-breaking Daily Supplement extra edition, and issued a statement applauding the enforcement and pointing to our new position paper calling for consistent, harmonized framework for state CBD regulation. “This recent announcement is another reminder to all of the need to establish a legal pathway to market for CBD dietary supplements," CRN's Steve Mister is quoted in Chain Drug Review.

FTC noted that the sweep shouldn’t come as big news to members of the CBD industry. "'It’s the Wild West out there!' How often have you heard that statement made about health claims for products containing CBD? But here’s the thing: It’s not the Wild West," the Commission said. The message to marketers has been consistent, FTC underscored, noting that the same substantiation principles the FTC has applied to health claims for close to 50 years apply to similar claims for CBD products. 

FTC also provided information for consumers, including a guide on ways to avoid being cheated by a "miracle" CBD cure.
